Terms of Service
Last updated:
These terms are the agreement between you and Ninebrook when you use our website (ninebrook.com) or our apps, starting with Digitlark (digitlark.com). We’ve kept them short and plain. By using our website or apps, you agree to them.
1. Who we are
Ninebrook (“we”, “us”) is a small app studio run by one person, based in Singapore. You can reach us at support@ninebrook.com.
2. Who can use and buy
- You must be 18 or older to buy a plan.
- Our apps for children are set up by a parent or guardian. A child may use them only on a parent’s device, after the parent has ticked the consent box. There are no child accounts. You are responsible for how your child uses the app.
3. Polar is the seller
All purchases are sold by Polar Software, Inc. (“Polar”), which acts as our merchant of record and reseller. So when you buy, you buy from Polar:
- Polar takes your payment and issues your receipt or invoice.
- Polar calculates and handles any sales tax or VAT.
- Polar handles payment disputes and chargebacks.
Polar’s checkout buyer terms (polar.sh/legal/checkout-buyer-terms) also apply to your purchase. Ninebrook makes the app, gives you access to what you bought, and provides support.
4. Digitlark plans and prices
Digitlark is launching soon. Until checkout opens you can only join the waitlist, and nothing is charged. Once it opens:
- Free: a 10-minute on-screen readiness check and a Brain Card.
- Sprint pass, USD 21.99: 12 weeks of access from the day you buy; if your contest is sooner, the plan is paced to contest day. 5 puzzles a day (new puzzles plus spaced review) with hints, a timed mock test every week, and progress reports. One payment. Does not renew.
- Puzzle Club, USD 4.99 a month or USD 39.99 a year: puzzles from the next level up, Think deeper cards and entry to every Digitlark Challenge weekend. A subscription that renews automatically at the end of each month or year until you cancel.
Prices include VAT or GST where it applies, except in the US, Canada and India, where any sales tax is added at checkout. In the UAE you pay in dirhams: AED 79 for the Sprint pass, and AED 19 a month or AED 149 a year for Puzzle Club. The final price is shown at checkout before you pay.
5. Renewals and cancelling
Puzzle Club renews automatically at the end of each month or year until you cancel. You get an email reminder before each yearly renewal. If we change a price, we’ll tell you at least 30 days ahead; the new price applies only from your next renewal after that, and you can cancel before then.
Open Digitlark and tap “Manage my plan”: it takes you to Polar’s customer portal, where you can cancel in a few clicks. Every receipt and renewal email from Polar also has a link to that portal. Or email support@ninebrook.com and we’ll cancel it for you.
A cancelled plan stays active until the end of the period you’ve already paid for, and you won’t be charged again.
6. Refunds
Your first Sprint pass and the first payment of your first Puzzle Club subscription come with a 14-day money-back guarantee. See our Refund Policy.
7. What our apps are, and aren’t
Digitlark is for practice. Its scores and levels come from our own puzzles. They are not official results of any competition, and Digitlark is not connected to or endorsed by any competition organiser. We check our puzzles carefully; if you spot a mistake, tell us and we’ll fix it.
8. Fair use
Use our apps for your own family. Don’t copy or resell our content, try to break or overload the service, or use it for anything unlawful. If someone does, we may suspend their access.
9. Our content
The apps, puzzles, text and designs belong to Ninebrook or its licensors. Buying a plan gives you a personal right to use them for your family for as long as the plan lasts.
10. If we close an app or a plan
If we stop offering an app or a plan, we’ll tell you by email at least 30 days ahead, stop all renewals, and refund the unused part of any prepaid period, such as a Sprint pass or a yearly Puzzle Club plan.
11. Changes to these terms
We may improve our apps and update these terms. For a change that affects your rights or what you pay, we’ll email you at least 30 days before it applies. If you don’t agree, you can cancel before then, and we’ll refund the unused part of any prepaid period. Small fixes, such as clearer wording, apply when we post them.
12. Liability
Our apps come with guarantees that can’t be excluded under consumer laws such as the Australian Consumer Law and the UK Consumer Rights Act. If an app is faulty, you’re entitled to have it fixed or to a refund.
Beyond those guarantees, we work hard to keep our apps running and correct but can’t promise they will always be available or free of errors. As far as the law allows, our total liability to you is limited to what you paid for the app in the 12 months before the claim. This limit doesn’t apply to fraud, gross negligence, death or personal injury caused by our negligence, or anything else the law doesn’t let us limit. Nothing in these terms limits rights you have under consumer protection laws that can’t be excluded.
13. Governing law
These terms (your licence to use our apps) are governed by the laws of Singapore; your purchase from Polar is governed by Polar’s buyer terms. If you live somewhere else, you also keep any consumer protections that the law where you live gives you.
